When a foreign national is charged with a violation of the immigration laws, Department of Homeland Security serves the foreign national with a Notice To Appear. A Notice To Appear is an order requiring the foreign national to appear before an immigration judge; additionally, a Notice To Appear advises the foreign national of the nature of the proceedings, the alleged immigration law violations, and the consequence of failing to appear.
Generally, immigration court proceedings involve an initial “master calendar” hearing and, subsequently, an “individual” hearing. During the master calendar hearing, the immigration judge ensures that the foreign national understands the immigration violation charges, and during this hearing, the merits of the case and available relief are discussed before the immigration judge.
